In compliance with the Federal Law for the Protection of Personal Data Held by Private Companies or Individuals (Ley Federal de Protección de Datos Personales en Posesión de los Particulares, the “Law”), ALVEOKAPITAL, S.A.P.I. DE C.V. (“ALVEOKAPITAL”) with address at Avenida Paseo de los Virreyes, número exterior 45, número interior 7-114 A, Col. Puerta de Hierro, Zapopan, Jalisco, México, C.P. 45116, hereby establishes the privacy notice (the “Privacy Notice”) which will apply with regard to protecting and safeguarding your personal data, preventing any damage, loss, destruction, theft, or alteration thereof, as well as any unauthorized handling of your personal data. 

Purpose

All personal information that has been provided or made known to ALVEOKAPITAL will be used in the provision of real-estate development services, as well as the undertaking of design projects, construction, promotion, administration, maintenance, subdivision and consulting services regarding housing, residential condominiums, warehouses, bays or industrial, commercial and/or tourist parks or complexes within the national territory (Mexico) or abroad that has been requested, or to notify or establish any necessary contact related to the provision of the services and in general to comply with the purpose of the relationship that has resulted in the handling of personal data.

What information do we collect?

The personal data that you freely and voluntarily provide to us in writing, verbally, through our website, social networks, email or through the use of any online service related to ALVEOKAPITAL may include: name; marital status; autographic and electronic signature; Federal Taxpayers Registry (RFC); Unique Population Registry Code (CURP); place and date of birth; nationality; photograph; age; address; e-mail; landline telephone number; mobile phone number; professional experience, work address, work references; professional or technical development and training, property or equity information concerning your assets, rights, liens or obligations subject to financial assessments, such as personal or real property; tax information; credit history; income and expenses; bank accounts; insurance; bonds (all of the above, jointly or separately shall be referred to as, the “Personal Data”).

With whom do we share your information?

Personal Data collected may be transferred to correspondents, subsidiaries, government agencies, agents, financial institutions, suppliers, employees, collaborators, associates and legal and/or accounting firms with whom we have entered into confidentiality and Personal Data protection agreements, with the understanding that they will only be allowed access to your Personal Data in order to comply with the provision of the contracted services for the purposes set forth in this Privacy Notice in accordance with Article 37 of the Law and that the consent granted by you also covers such transfer of information.

 Any transfer of Personal Data that ALVEOKAPITAL carries out will be undertaken according to the guidelines established in the preceding paragraph and, otherwise,  in no case will your Personal Data be commercialized, sold or rented or leased to a third party without your prior consent. It shall be understood that you have given your consent to the transfer of your Personal Data if you fail to express your objection to their transfer.

Security and control measures for the protection of your Personal Data

ALVEOKAPITAL has implemented administrative, technical and physical security measures to protect your Personal Data, which we also require to be complied with by the service providers we hire. Your data is stored and protected in order to prevent its loss, misuse or alteration.

ARCO Rights

In accordance with all legal provisions, the holder of the rights, by his/her own right or through his/her legal representative, may request that ALVEOKAPITAL, at any time, allow any access, rectification, cancellation, opposition or objection (jointly or separately, the “ARCO Rights”) with respect to the Personal Data or Sensitive Personal Data concerning him/her. 1. Access. You may verify the data held by ALVEOKAPITAL, which will be made available to you either through hard copies, electronic documents or by any other means specified by ALVEOKAPITAL. 2. Rectification. In case ALVEOKAPITAL has inaccurate or incomplete data, you may request the total or partial modification of such data, as long as you submit the supporting document proving the error or modification thereof. 3. Opposition. You shall have the right at any time and for legitimate reasons in accordance with the Law, to oppose the partial or total processing of your Personal Data or Sensitive Personal Data collected, and you may point out specific cases or situations for such opposition. 4. Cancellation. You may request that ALVEOKAPITAL cancel the processing of your Personal Data or Sensitive Personal Data collected if you consider that such Data are not required for any of the purposes stated in this Privacy Notice or are being used for purposes that have not been consented. The request must be made in writing and must contain and be accompanied by the following: (i) name of the holder and address or other means to communicate the response to your request; (ii) a copy of the identification document of the holder, as well as the original thereof for comparison or, if applicable, in the case of the representative of the holder, in addition to the above (identification of the holder), the documents proving the identity of the representative, as well as the public instrument or power of attorney signed before two witnesses, in which the powers granted are stated, or a statement to such regard made in person by the holder; (iii) a clear and precise description of the Personal Data or Sensitive Personal Data with respect to which the holder seeks to exercise any of the ARCO Rights, and (iv) any other element or document that may facilitate the location of the Personal Data or Sensitive Personal Data. Such request shall be submitted at the address designated to receive notices or by e-mail to the following address: derechosARCO@kampusdesarrollos.com; provided that all duly certified electronic instruments that replace the holder’s identification documents or, as the case may be, of its representative, are submitted.

In the event that ALVEOKAPITAL denies the exercise of any of the ARCO Rights, it must justify its response, informing the holder of his/her rights to request the initiation of the required procedure before the Federal Institute of Access to Information and Protection of Personal Data.

Changes to the Privacy Notice

ALVEOKAPITAL has the right to make changes or updates to this Privacy Notice at any time, due to legislative reforms, internal policies or new requirements for the provision or offering of our services or products. These changes will be made available to the holders through any of the following means: visible announcements on our website, our social networks or sending a notice to the last email you have provided us.
